What Is the Difference Between a Flat and an Apartment?

Short answer: In India there is no legal difference between a flat and an apartment. Both words mean the same home. Indian law says so in writing. The Real Estate (Regulation and Development) Act, 2016 defines "apartment" and lists "flat" as one of its other names. The Gujarat Ownership Flats Act, 1973 defines "flat" and says it "includes an apartment". So when a builder says apartment and your family says flat, you are both talking about the same thing. 

The Difference Between Flat and Apartment in India 

A flat and an apartment are the same type of home. Both are self contained units inside a larger building. Both have their own door, kitchen, bathroom and rooms. Both share the staircase, lift, parking and terrace with other owners. 

The word you hear depends on who is talking: 

  • Flat is the British English word. India follows British English, so most families, banks and state laws use "flat". 

  • Apartment is the American English word. Builders and ad teams like it because it sounds posh. 

The walls, the carpet area, the loan and the stamp duty stay exactly the same. Only the word changes. 

What Is a Flat? 

A flat is a separate, self contained home inside a bigger building. You own the space inside your door. You share the land, lift, lobby and other common parts with everyone else in the building. 

That is the plain meaning. It is also the legal one. 

Section 2(a) of the Gujarat Ownership Flats Act, 1973 puts it this way: 

"a separate and self-contained set of premises forming part of a building and used or intended to be used for residence or office, or show-room, or shop or godown or garage; and includes an apartment."

What Is an Apartment? Apartment Meaning Explained 

An apartment is a self contained home inside a shared building. Same thing as a flat. 

If that sounds too simple, here is the proof. Section 2(e) of the Real Estate (Regulation and Development) Act, 2016 says: 

"apartment" whether called block, chamber, dwelling unit, flat, office, showroom, shop, godown, premises, suit, tenement, unit or by any other name, means a separate and self-contained part of any immovable property..." 

Look at the list of names. Flat sits right inside the legal meaning of apartment. RERA treats the two as one and the same word.

So why two words? 

"Flat" comes from an old Scottish word, "flet", meaning the floor or inner part of a house. It passed into British English, and British English came to India. 

"Apartment" reached English from French and Italian, where it meant a set of rooms kept apart for one family. American English picked it up, and Indian builders picked it up from there because it reads well in a brochure.

Read the table again and you will see the pattern. Every row that could have separated the two words ends up saying the same thing twice. Apartment vs flat, in the end, is a question about language. 

The word does not change the value of a home. The location, the carpet area, the builder, and the papers do.

The One Difference That Actually Matters in Gujarat 

Ask most agents this question and the answer stops at language. That is where almost every article stops too. 

But there is a real difference here, and it sits in your sale deed. 

The Gujarat Ownership Flats Act, 1973 gives a builder two ways to hand over a finished building. Both are legal. Both are common in Ahmedabad and Gandhinagar. They work very differently for you as an owner. 

Route 1: The co-operative society 

Under Section 10, once enough buyers have taken flats, the builder must apply to the Registrar to form a co-operative society or a company

What that means for you: 

  • The society becomes the legal owner of the land and building. 

  • You get a share certificate in your name, plus the right to occupy your flat. 

  • Section 11 says the builder must clear his title and pass it to that society. 

  • Resale and transfer go through the society office and its managing committee. 

Route 2: Apartment ownership 

Part II of the same Act is titled "Provisions for ownership of apartments". Section 10(2) adds a sharp line: if the buyers put the building under Part II, it is not lawful to form a co-operative society for it at all. 

What that means for you: 

  • You own your apartment directly, along with a fixed share of the common areas. The Act calls it heritable and transferable property. 

  • Your share of the common areas is written as a percentage in a document called the Declaration

  • You get a registered Deed of Apartment instead of a share certificate. 

  • The building is run by an Association of Apartment Owners, not a society.

"Is this building under a co-operative society, or under apartment ownership?" 

The answer decides which papers you must collect, and how smooth your resale will be. This is the only difference in the whole topic that can cost you money.

What Builders in Ahmedabad Really Mean by "Apartment" 

Walk down SG Highway or the SP Ring Road belt and read the hoardings. You will see "The Residences", "Signature Apartments", "Sky Homes" and plain "Flats". Same city, same rules, different words. 

Builders choose the word for three reasons: 

  1. Price image. "Apartment" and "Residences" tend to go on higher priced projects. The word reads posh. 

  1. Buyer type. Projects aimed at NRI buyers and senior office staff use "apartment" more often. That group reads American English. 

  1. Habit. Local Gujarati speaking buyers ask for a "flat", so budget and mid range projects keep that word in their ads.

Advantages of Flats vs Apartments: What You Actually Gain 

Since the two words mean the same home, the useful question changes. It is no longer flat or apartment. It is this kind of home against an independent house or a villa. 

What you gain 

  • Lower entry price. A 2 BHK in Gota or Chandkheda costs far less than a plot plus build cost in the same area. 

  • Shared cost of extras. Lift, guards, water tank, garden and gym are paid for by the whole building. 

  • Safety built in. Gated entry, guards and CCTV come with the deal. 

  • Easier home loans. Banks lend faster against a RERA registered project with clear title. 

  • Less upkeep work. The society or association looks after pumps, lifts, paint and drains. 

  • Better rent demand. Near SG Highway, Science City, GIFT City and the Metro line, flats rent out faster than standalone houses. 

What to watch out for 

  • Monthly upkeep never stops. In many Ahmedabad projects it runs around ₹2 to ₹4 per sq ft per month, but it varies. Ask for the figure in writing. 

  • Carpet area is smaller than the ad number. Super built up area is often 25 to 35 percent more. 

  • Rules apply. Pets, repair timings, parking and terrace use are set by the society or association. 

  • Common walls mean shared noise. Check the corner units and where the lift shaft sits.

Flat or Apartment: Which Should You Buy? 

By now the difference between flat and apartment should be settled in your head. You are choosing the same product either way. So choose on these five things instead. 

  1. Carpet area, not super built up area. RERA calls carpet area the usable floor area inside your walls. That is the only number worth comparing across two projects. 

  1. RERA number. A project must be registered if the land is more than 500 square metres, or if it has more than eight apartments. Check it on the GujRERA portal before you pay a token. 

  1. Ownership route. Society or apartment ownership, as explained above. 

  1. BU permission. Without Building Use permission, a lived in building is not fully legal. Your loan or resale can get stuck. 

  1. Location and travel time. Metro, ring road, school, hospital and office distance decide resale more than any list of extras.

  • Title clearance certificate from an advocate

Words settled, here is the ground reality. If you follow real estate trends in India, Ahmedabad keeps coming up for one reason. The maths works here in a way it no longer does in the bigger metros. 

How affordable it is. Knight Frank India's Affordability Index for the first half of 2026 put Ahmedabad at the top of the national list. The city's EMI to income ratio was 23 percent, the lowest of the eight cities studied. Kolkata came next at 25 percent and Pune at 28 percent. NCR stood at 67 percent and MMR at 69 percent. 

Supply and prices. Cushman & Wakefield's Ahmedabad MarketBeat for the second quarter of 2026 counted 6,143 new units launched, 19 percent more than the same quarter last year. Prices rose about 12 percent year on year. Most of that came from West Ahmedabad and the western belt, covering Shela, South Bopal, Bopal, Hebatpur, Gota, Tragad and Ognaj. 

A note on listings. Search for flats for sale in Ahmedabad and the results will mix flat, apartment and residences on the same page. Do not read anything into it. Sort by carpet area and RERA number instead. The same goes for Gandhinagar, where listings in Sargasan, Kudasan and the GIFT City belt use all three words. 

Put together, these numbers explain something we see every month. A family that would still be renting in Mumbai or Bengaluru is already paying an EMI here. That is the real story behind a flat in Ahmedabad, and increasingly behind a flat in Gandhinagar too.

Three Mistakes Buyers Make Over One Word 

  1. Paying more for the word. Two towers in the same lane at the same carpet area rate. One says apartments, one says flats. Buyers assume the "apartment" is better built. Check the spec sheet instead. 

  1. Assuming the extras are included. Gym, pool and clubhouse show up in both brochures. Ask which ones are in the RERA plan and which come in phase two. 

  1. Ignoring the ownership route. Buyers sign without asking whether the building is under a society or under apartment ownership. Later, resale gets held up.
